Acceptance of terms

By creating an account or using Fixly, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must discontinue use of the service immediately.

Account registration

You sign in to Fixly using Google Authentication via Firebase. By creating an account, you represent that the information provided is accurate and that you are authorized to use the Google account associated with your sign-in.

You are responsible for maintaining the security of your account and for all activity that occurs under it. Notify us immediately if you suspect unauthorized access. Fixly is not liable for losses caused by unauthorized use of your account.

Service description

Fixly is an AI-powered growth execution platform that provides website analysis, conversion optimization recommendations, lead generation tools, automated outreach, website monitoring, and related growth features. The specific features available to you depend on your subscription plan.

Plans and billing

Credits

Most actions on Fixly consume credits. Each plan includes a monthly credit allocation that resets at the start of each billing cycle. Unused credits do not roll over to the next month.

Checkout and billing cycle

Plan upgrades are purchased through PayPal as one-time payments initiated from your account. Your plan's monthly credit allocation and reset schedule are managed in Fixly; we do not store an auto-renewing PayPal subscription for you unless we explicitly offer that in the product and you enroll.

Payment and access

If you do not purchase a paid plan, you remain on the free tier. If you choose to move back to the free tier from a paid plan, your account limits update at that time. You retain access to your data; premium features depend on your current plan.

Refunds

Credits that have already been consumed are non-refundable. Paid checkout amounts follow PayPal's policies and any refund handling we agree to in writing. Contact support if you believe a charge was made in error.

Cancellation

You may switch to the free tier at any time from Dashboard → Profile → Plan & credits ("Switch to Free plan"). That change takes effect immediately. You may purchase a paid plan again at any time.

Acceptable use

You agree not to:

• Abuse, overload, or interfere with Fixly's infrastructure, APIs, or services.
• Use automated tools, bots, or scrapers to access Fixlybeyond the limits of your plan.
• Submit URLs of websites that contain illegal, harmful, or prohibited content for analysis.
• Resell, sublicense, or redistribute Fixly outputs without authorization.
• Attempt to reverse-engineer, decompile, or extract the source code of the platform.
• Use the service to harass, spam, or conduct any activity that violates applicable laws.

We reserve the right to suspend or terminate accounts that violate these terms.

Intellectual property

Fixly and its platform, branding, design, code, algorithms, and documentation are the intellectual property of Fixly and its licensors. All rights not expressly granted are reserved.

You retain ownership of any content, data, and materials you submit to Fixly. By submitting content for analysis, you grant Fixly a limited, non-exclusive license to process, analyze, and store that content solely for the purpose of delivering the service to you.

AI-generated content disclaimer

Fixly uses artificial intelligence to generate analysis reports, recommendations, outreach content, and other outputs. These are provided as guidance and suggestions only — they do not constitute professional advice and are not guaranteed to produce specific results.

You are solely responsible for reviewing, validating, and implementing any AI-generated suggestions. Fixly does not guarantee the accuracy, completeness, or suitability of AI outputs for your specific use case.

Third-party services

Fixly integrates with third-party services including Google (authentication), PayPal (payments), and OpenAI (AI analysis). Your use of these services is subject to their respective terms and privacy policies. Fixly is not responsible for the availability, accuracy, or practices of third-party providers.

Limitation of liability

Fixly is provided on an “as-is” and “as-available” basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, Fixly and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or related to your use of the service.

Our total aggregate liability for any claims arising from your use ofFixly is limited to the total fees you paid to us during the twelve (12) months immediately preceding the event giving rise to the claim.

Indemnification

You agree to indemnify and hold harmless Fixly, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the service, violation of these terms, or infringement of any third-party rights.

Termination

Either party may terminate this agreement at any time. You may close your account through your account settings or by contacting us. We may suspend or terminate your account if you violate these terms or for any other reason with reasonable notice.

Upon termination, you will have a 30-day window to export your data (reports, analyses, and leads). After this period, we may delete your account data in accordance with our privacy policy.

Governing law

These terms are governed by and construed in accordance with applicable laws. Any disputes arising from these terms or your use ofFixly shall be resolved through good-faith negotiation first, and if necessary, through binding arbitration or the courts of competent jurisdiction.

Changes to these terms

We may update these terms from time to time. When we make material changes, we will notify you via email or a prominent notice on your dashboard at least 14 days before the changes take effect. Continued use of Fixly after updated terms become effective constitutes your acceptance.
